Abstract (English):
ANNOTATION. Introduction. Currently, the problem of road traffic injuries involving vehicles of operational services performing urgent official tasks is not solved, and the need to solve it becomes even more urgent in connection with the current situation in our country. The movement of such vehicles in conditions of time constraints, rapidly changing road conditions, deviations from established traffic rules, requires high concentration of attention not only from employees and employees of operational services operating such vehicles, but also from other road users. Meanwhile, the need for strict implementation Meanwhile, the need for strict compliance with established rules, instructions and orders allows for security, while legitimate requirements must contain all the properties of legal norms, be interpreted unambiguously and not cause legal conflicts. Methods. The methodological basis of the research consists of general scientific methods: analysis, synthesis, induction, deduction; private law methods: comparative jurisprudence and legal forecasting. Results. The article provides an overview of judicial practice on the consideration of cases of administrative offenses provided for in Part 2 of Article 12.17 of the Administrative Code of the Russian Federation. The authors focus on the technical, legal and organizational aspects of ensuring the safety of the passage of vehicles of operational services in the conditions of performing an urgent official task and the use of special light and sound signals. The international experience of using special light and sound signals is presented, attention is focused on the formulations used in relation to road users to ensure the safety of the passage of an operational service vehicle. The authors present a classification of the circumstances under which the cancellation of the decision of an official to bring to justice for not providing an advantage in movement to a vehicle with special light and sound signals turned on, as well as proposals for amendments to existing regulatory legal acts.
