HISTORICAL BACKGROUND OF THE INSTITUTION OF CORRECTIONAL LABOR

Abstract (English):
: Introduction. The relevance of the topic is related to the objective need to study the issues of the emergence of the institute of correctional labor from the standpoint of rethinking historical experience in relation to modern conditions, this will avoid mistakes in sentencing and make more objective decisions regarding its development in the future. In the article, the author tracks the historical background and trends in the development of the institute of correctional labor as a type of criminal punishment unrelated to the isolation of the convict from society. It is established that the use of correctional labor is justified by factors of a socio-philosophical and economic nature. It is concluded that correctional work began to be applied in domestic practice relatively recently, namely after the October Revolution of 1917, and at the present stage it is a fairly popular form of corrective action on perpetrators, which is confirmed by statistical data. It is emphasized that the institution of correctional labor is not a "frozen" type of punishment and in the future its further improvement and transformation is possible, based on objectively prevailing conditions and factors of development of society. Methods. The research used methods of systematization and generalization of scientific information, comparative legal research method, historical method, etc. Results. The result of the study was the identification of key stages in the development of such a type of punishment as correctional labor in the Russian Federation. It was concluded that correctional labour in its elementary composition and essence changed with the adoption of the new Criminal Code of the RSFSR and the ITC of the RSFSR, and at the present stage is regulated by the Criminal Code of the RF and the Penal Enforcement Code of the RF.
