Abstract (English):
Introduction. The article emphasizes the relevance of criminal law protection of property rights. The article provides a comparative analysis of individual features of the crimes provided for in paragraph “g” of Part 3 of Art. 158 and art. 159.3 of the Criminal Code of the Russian Federation, some theoretical and applied aspects of the study of these forms of contactless theft are highlighted. A distinction is made between the socially dangerous acts under consideration, including the nature and direction of deception as a method of facilitating access to property, in one case, and as a method of confiscating it, in the second. Not only the main scientific works on a related research topic have been studied, but also judicial practice on the application of criminal legislation in the field of protection of property rights has been summarized. Methods. The methodological basis of scientific research included both general scientific (analysis, synthesis, deduction, generalization, classification, comparison) and private scientific methods (formal legal, method of document analysis and comparative legal). Results. Attention is drawn to cases of reclassification of acts from fraud to theft, and the reasons are analyzed. Criticism of certain provisions on the issues of delimiting the qualifying elements of theft and a special type of fraud is given. Criteria for distinguishing these crimes are proposed.
